Tax authorities around the world are tightening their grip on cross-border transactions. Regulations continue to expand, and the pressure on corporate taxpayers to choose appropriate transfer pricing methods and document those choices has never been greater. For companies operating in multiple jurisdictions, a misaligned approach can trigger audits, penalties and reputational damage.
This five-day course addresses those pressures directly. Day one sets out the international legal framework, covering the arm's length principle, domestic transfer pricing regimes and the importance of OECD and UN model tax treaties. Day two turns to Base Erosion and Profit Shifting (BEPS) action plans, examining how the Multilateral Instrument (MLI) under BEPS Action 15 affects existing treaties, how to assess beneficial ownership status, and how anti-abuse rules apply to corporate tax structuring.
Days three and four examine transfer pricing in depth. Intra-group relations are studied alongside the five main pricing methods: the comparable uncontrolled price (CUP) method, the resale price method (RPM), cost-plus, the transactional net margin method (TNMM) and the profit split method (PSM). The commodity rule is also covered. Day five focuses on documentation under OECD Chapter V guidance and on resolving disputes through BEPS Action 14 mechanisms. The programme draws on case studies, group work and interactive exercises throughout.
