Course overview

Claims require attention to contractual procedures and the records supporting them. This programme provides practical assistance with the FIDIC Contract Conditions in their 1999 and 2017 Editions, covering management and resolution of claims and the operation of the Dispute Adjudication Board. Variations come first. Delegates examine Clause 13, the Engineer's role and the different approaches in Construction and Plant and Design-Build contracts.

The claims sessions follow project and contractual risks through notices, contemporary records, preparation, assessment, valuation and determination. Delay and additional-payment claims are considered alongside employer financial claims, defects, retention and bonds. The course also examines case law and other authorities and practical feedback from FIDIC practice and claims consultancy. Responsibilities of the Employer, Engineer and Contractor connect with termination, suspension, risk, force majeure and dispute resolution, before DAB types, member selection, guarantees, obligations, costs and payments are reviewed.
