Older trademark records and commentary often describe a dual-treaty Madrid System, which can confuse readers using the current framework. This course explains the historical relationship between the Madrid Agreement and the Madrid Protocol without presenting the Agreement as an alternative route for new applications. It examines the problems the Protocol addressed, the significance of transitional rules and the distinction between a treaty's historical role and its present operational relevance. Delegates learn to place older terminology and procedural references in context.
Day 1 traces the Agreement's original structure and constraints. Day 2 compares the Protocol's approach to basic applications, refusal periods, fees and transformation. Day 3 follows the transition to Protocol-only operation and the freezing of accessions under the Agreement in 2016. Day 4 examines treaty provisions, regulations and declarations through selected legal interpretation exercises. Day 5 applies this historical understanding to legacy registration records and internal guidance. Across the five days, delegates practise checking the relevant instrument and date before drawing conclusions, while distinguishing treaty interpretation from routine application processing.
