Legal and commercial professionals compare mediation, arbitration and WIPO procedures for intellectual property disputes over 5 days. Delegates practise assessing suitable routes, drafting procedural instructions and preparing for settlement discussions. The course also examines domain name disputes under the UDRP, distinguishing that specialised process from commercial arbitration and court-based infringement claims.

Intellectual property disputes often combine legal issues with ongoing commercial relationships, confidential information and rights in several territories. The most suitable procedure depends on the parties' objectives, the need for urgent relief, consent to the process and the nature of the remedy sought. This course examines negotiation, mediation and arbitration alongside litigation, with a focus on the services of the WIPO Arbitration and Mediation Center. It also explains why domain name disputes under the UDRP follow a separate, narrowly defined procedure.
Day 1 develops a dispute assessment covering facts, evidence, objectives and procedural choices. Day 2 explores mediation preparation, interests and settlement terms. Day 3 considers arbitration agreements, tribunal selection, evidence and award enforcement issues. Day 4 compares WIPO mediation, arbitration, expedited arbitration and expert determination, then examines UDRP requirements and remedies. Day 5 uses a simulated dispute to practise route selection, procedural planning and settlement decisions. Across the five days, delegates consider confidentiality, cost and timing as factors requiring assessment, and learn to distinguish a negotiated outcome from an adjudicated decision.
By the end of the course, delegates will be able to:
